TERMS & CONDITONS B2C

1                 GENERAL INFORMATION

The web shop found on the web site [www.blaklader.com] (the “Web Shop”) is run by AB Blåkläder, a legal entity incorporated in Sweden with company registration number 556069-6618, Box 124, 512 23 Svenljunga (below referred to as ”Blåkläder”).

If you are below 18 years of age you need permission from your guardian to place an order in the Web Shop. By using the Web Shop and/or placing an order, you accept these general terms and conditions (the ”General Terms and Conditions”).

Blåkläder reserves the right to – from time to time – amend these General Terms and Conditions and any changes Blåkläder makes will enter into force no earlier than thirty (30) days after the revised General Terms and Conditions have been made available on the Web Shop.

2                 PRICES AND DELIVERY CHARGES

All prices shown in the Web Shop include [Swedish] Value Added Tax of 25%, except for safety shoes, but exclude delivery charges (see exact charges below). Please note that Blåkläder does not compensate any local customs duties, local VAT on imports or similar fees which may be added to deliveries outside of Sweden. No additional taxes or charges, other than those listed on your order or mentioned in these General Terms and Conditions, will be added when you complete your purchase.

If the VAT is changed, Blåkläder reserves the right to adjust its prices and charges by a corresponding amount. Further, Blåkläder reserves the right to correct pricing errors and adjust prices in case of exchange rate fluctuations which make listed prices incorrect. Blåkläder also reserves the right to make running adjustments to prices and cancel products and/or orders in case stock of particular products is sold out. Blåkläder also reserves the right for any printing or typographical errors on the Web Shop.

Periodic sales and/or campaign offers are valid unless otherwise stated, as long as the products are available in stock and/or until the end date is reached under the terms specified in each offer/campaign.

3                 ORDERING AND CONFIRMATION OF PURCHASE

Any order must amount to at least 100£ (Swedish VAT, 25%, included) (after deduction of discounts) in order to be processed. For orders below £100 order value, £4.96 transport cost will be charged.

After you have made a purchase you will receive a confirmation of the purchase to the e-mail address provided by you at the time of the placing of your order. The confirmation will be sent to you within reasonable time and no later than at the time of delivery of the purchased product/s.

4                 DELIVERY

Blåkläder delivers its products to Sweden, Denmark, Norway, Finland, Germany, Austria, Netherlands, Great Britain, France, Italy and Spain. All parcels will be sent via Schenker (Sweden), PostNord (Norway), Itella (Finland) and Schenker Parcel (Rest of Europe (Countries stated in Note 2)). Parcels are delivered to your nearest service point, with notification via text messages, to the mobile phone number that you stated on your order, or by paper slip notification to your mail box.

Blåkläder’s aim is to always deliver your purchased product(s) as quickly as possible. If your product is available in stock, the delivery time is normally 3 working days in Sweden, Norway and Finland, and 5 working days for the other European countries, stated in Note 2. The delivery time is counted from the time of order placement until the purchased product is available for you to pick-up at your nearest service point.

If the product that you have purchased is not available in stock or delays are caused due to other circumstances, delivery times may be longer. Even though Blåkläder aims to deliver the product that you have purchased within the communicated time frame, delivery may take longer. Blåkläder will inform you, without delay and as soon as possible.

5                 UNCLAIMED PARCELS

If you do not pick up your purchased product at the service point, Blåkläder will charge you for the actual costs for freight charges and return freight charges.
 

6                 PAYMENT METHODS AND SAFETY

Payment can be made with the following valid credit or debit cards: Visa, MasterCard, Apple Pay, PayPal.

When you pay by card, the transaction is processed by DIBS in order to ensure fast and secure payment which meets the PCI-DSS requirements. Blåkläder does not save your card details. All information is encrypted and sent to DIBS via secure servers (SSL/HTTPS). / The applicable amount will immediately be reserved on your card but will not be debited until the product is dispatched. Blåkläder reserves the right to check the validity of the credit or debit card, its credit status in relation to the order value and whether the address data of the purchaser is correct. Blåkläder may refuse orders depending on the result of these controls.

7                 CANCELLATIONS, REPLACEMENTS AND COMPLAINTS

Please note that if you wish to cancel, replace or complain about a product that you have purchased, you stand the risk for the transportation of the product back to Blåkläder. This means that you are responsible for any damage or loss of the product during the transportation of the product to Blåkläder. Blåkläder recommends you to always save the receipt until the return of your product has been completed.

RETURNS

Please note that returns and claims are handled separately. If you wish to make a warranty claim, please read the instructions on how to do so further down the page under ‘Complaints’.

Returns are also handled differently depending on whether your order is linked to a business account or not. Please read more about how to return garments under ‘B2B orders’ and ‘B2C orders’

RETURN CONDITIONS

  • Goods being returned within 35 days of the order date can be returned without any deduction.
  • For returns made between 35 and 95 days after the order date, a 15% deduction will be applied. Items cannot be returned more than 95 days after the order date.
  • The goods need to be returned in its original condition and in its original packaging. Size and warranty labels cannot be removed from the goods. A fee of £5 per garment for re-wrapping will be charged for goods not packed in its original packaging.
  • We do not accept return of garments that have been refined in any way.
  • Eventual price label/price tag cannot appear on the returned garment.
  • The return freight is to be paid by the customer for returns being made unless an incorrect delivery is made or the item is faulty, then return freight is to be paid by Blåkläder.
  • If you choose to cancel and return your purchased product, Blåkläder will refund what you have paid, including any freight and delivery charges for delivery to you, though any return charges will be withdrawn from the amount refunded. However, if you choose to cancel/return only part of your order Blåkläder will not refund any delivery charges, since the same charges apply no matter how many products you order.
  • The refund will be made as soon as possible and within fourteen (14) days from Blåkläder’s receipt of your message regarding cancellation (or for B2C orders; that you have registered your return online), provided that Blåkläder, by this date, has received the product that you would like to return or that you have provided Blåkläder with a proof of the product being sent to Blåkläder.
  • If your handling of the product that you have purchased has resulted in a decreased value of the product, Blåkläder will make a deduction of the refund corresponding to the amount of the loss of value of the product.

B2B ORDERS

If you order is linked to a business account, it cannot be returned online. Please contact Blåkläder by email at uksales@blaklader.com to initiate a return.

COURSE OF ACTION

1. Make sure that the garment you wish to return is an approved return according to the conditions above.

2. The return form needs to be correctly filled in and put in the package. Returned volume and reason for return needs to appear on the slip. A deduction of 20% of the value of the article (at least £5) will be made if documentation is missing.

3. Send your parcel to Blåkläder Workwear Ltd (address to be found on the return slip), using standard delivery.

B2C ORDERS

Have you changed your mind? If something is not right with your order, you can register a return online However, this service does not include exchanges. To exchange a product, register your return online, send the product back and then order a new one via our online shop.

Already a customer? Sign in to your customer portal to manage your return more easily.

Please note that it is not possible to cancel or withdraw from your purchase once it has been completed, but before the goods have been delivered. Returns are only possible once the products have been delivered.

COURSE OF ACTION

1. Make sure that the garment you wish to return is an approved return according to the conditions above.

3. Fill in the returns form enclosed with your order.

4. Make sure to include the returns form in the parcel.

COMPLAINTS

You have the right to make a complaint about a product within three (3) years from the date of receipt of the product, provided that the product was faulty at the time of delivery. Please contact Blåkläder as soon as possible after you have noticed that there is something wrong with the product, on telephone number +44 (0) 1604 437 045 or by e-mail uksales@blaklader.com.

Please note that you need to make a complaint about the fault of the product “within reasonable time” after you discovered it. If you notify Blåkläder within two (2) months from the date of your discovery of the fault, you have made the complaint “within reasonable time”.

If you, after contacting Blåkläder, are asked to return the product, please send it to Blåkläder on the following address;

When Blåkläder has received the product that you wish to complain about, Blåkläder will decide on whether or not the product is faulty. In the event of the product being faulty, Blåkläder will, as soon as possible and no later than 30 days from the date of Blåkläder’s receipt of the product, either repair the product, send you a new faultless product or give you a refund of what you have paid, including freight and delivery charges. If the product is faulty, Blåkläder will compensate you for any return freight charges.

The Web Shop may, from time to time, contain links to or from other web sites, which are not controlled by Blåkläder. Although Blåkläder will do its utmost to make sure that the links on the Web Shop only transfers you to web sites which share Blåkläder’s safety and confidentiality standards, Blåkläder cannot be held responsible for the protection or confidentiality of any data that you may submit on these third party web sites. Before submitting information on such web sites, Blåkläder recommends that you read the privacy notices and other statements or policies found on these web sites.

9                 TECHNICAL REQUIREMENTS

In order to be able to use and place an order in the Web Shop by making use of your computer, iPhone, iPad, Android or other device, there may be certain technical requirements. You may, for example, need to install certain software, such as any regular web browser. If your device does not meet the technical requirements, you will, via pop-up boxes or similar, get information about what software or the like that you will need to install in order to use and to place an order in the Web Shop.

10               AVAILABILITY

Blåkläder’s aim is to make the Web Shop work satisfactory at all times. However, the Web Shop is provided as it is and with the quality it has.

Blåkläder does not claim that the Web Shop is appropriate or even that it can be used outside of Sweden, Denmark, Norway, Finland, Germany, Austria, Netherlands, Great Britain, France, Italy and Spain.

11               GOVERNING LAW AND DISPUTE SOLUTION

These General Terms and Conditions are governed by Swedish law, without regard to its conflict of law provisions.

Any dispute, controversy or claim arising out of or in connection with your use of or purchase from the Web Shop and/or these General Terms and Conditions, or the breach, termination or invalidity thereof, shall at first instance be settled by the District Court of Gothenburg. This applies to any claim involving Blåkläder or its affiliates, subsidiaries, employees, contractors, officers, directors, telecommunication providers and content providers.

12               INVALIDITY

Should any provision of these General Terms and Conditions or part thereof be void or invalid, the other provisions of these General Terms and Conditions shall remain in force and the clause may be amended to the extent such invalidity materially affects the rights or obligations of you or Blåkläder under these General Terms and Conditions.
